The European Parliament approves the controversial “Article 13”

In this week’s plenary session, the European Parliament approved the new Directive on Copyright in the Digital Single Market. This Directive has been in the spotlight due to its “article 13” (renumbered article 17 last February), which burdens content providers with the obligation to “prevent the availability on their services of works or other subject-matter identified by rightholders”.

The proponents of this provision maintain that it will allow creatives to obtain proper remuneration for their work. Meanwhile, its detractors claim that content providers will be forced to systematically take down content as it would be impossible to inspect all content for copyright compliance.

According to the EU’s ordinary legislative procedure, the final decision on whether to adopt the Directive now rests with the Council of the European Union.
